TERMS & CONDITIONS + REFUND POLICY + ACCESS AGREEMENT

1. INTRODUCTION
These Terms & Conditions (“Terms”) govern your purchase and use of any digital product, course, live program, or service (collectively, the “Offerings”) provided by Butterfly Heart Spiritual Healing (“we”, “us”, “our”).
By completing your purchase, you agree that you have read, understood, and consent to be bound by these Terms.
If you do not agree, you must not purchase or access the Offerings.
2. DESCRIPTION OF OFFERINGS

Includes live sessions (delivered online), and 12 weeks of access to the group content library and portal.
All inclusions will be clearly listed on the sales page and/or checkout page at time of purchase.
3. PAYMENT TERMS

All prices are listed in AUD unless stated otherwise.

Payments are processed via Kajabi’s secure payment gateway (e.g. Stripe / PayPal).

Access is granted only once successful payment is received.

By purchasing, you authorise us to charge your payment method for the full amount.
If your payment fails, access may be automatically revoked until resolved.
4. ACCESS & ACCOUNT RESPONSIBILITIES

You will receive login details to access your digital content via Kajabi.

You are responsible for maintaining the confidentiality of your login details.

You must not share, transfer, gift, or sell your login or access to any third party.

Any breach may result in immediate removal from the Offering without refund.
5. INTELLECTUAL PROPERTY (READ CAREFULLY)
All content inside the Offerings — including audio files, scripts, videos, worksheets, branding, techniques, frameworks, designs, and written materials — is the exclusive intellectual property of Butterfly Heart Spiritual Healing.
You are granted a personal, non-transferable, non-exclusive licence to access and use the materials for your own personal use only.
You must NOT:

Share, distribute, or publish any content

Upload content to shared drives or platforms

Reproduce or create derivative works

Use the content in your own paid or free programs

Claim the content as your own
-
Screen-record, repackage, or resell any part of the materials
Unauthorised use may result in legal action and/or immediate removal from the Offering.
6. RESULTS & DISCLAIMER
We are committed to providing high-quality educational and energetic support. However:

We do not guarantee specific results, outcomes, or transformations.

Results vary depending on personal effort, capacity, readiness, mindset, and life circumstances.

Our Offerings are educational and self-development tools, not medical, psychological, financial, or legal advice.
You agree that you are solely responsible for how you use the materials.
7. TECHNICAL REQUIREMENTS
To participate, you are responsible for ensuring:

A stable internet connection

A device capable of streaming or downloading content

Up-to-date browsers/software

Access to your email (for login and updates)
Technical issues on your end do not qualify for refunds.
8. REFUND POLICY
(Compliant with Australian Consumer Law – ACL)
We honour all rights under the Australian Consumer Law (ACL).
This means you are entitled to a remedy (refund, repair, or re-supply) if there is a major problem with the Offering.
You are entitled to a refund if:
A “major failure” occurs, including:

The product is significantly different from what was advertised

The content is unusable (e.g. corrupted file, broken link) and cannot be re-supplied

We fail to deliver the live component as described

You cannot access the content due to an error on our end that we cannot resolve
You are NOT entitled to a refund if:
Because digital courses & programs provide immediate access, refunds will not be granted for:

Change of mind

Deciding the Offering is “not right for you”

Not engaging, watching, or completing the content

A change in your personal circumstances

Financial hardship
-
Inability to attend live calls

Time-zone differences
-
Technical issues on your device / internet

Inability to keep up with the course pace

Unused access
This is standard for digital products and online courses under Australian law.

9. CANCELLATION (LIVE PROGRAMS)
For live programs (Grounded + Empowered):

Your enrolment is final.

Non-attendance does not warrant a refund, credit, or transfer.

If you breach group guidelines or behave in a way that is harmful or inappropriate, we may remove you from the program without refund.
10. WARRANTIES & LIABILITY LIMITATION
To the extent permitted by Australian law:

We exclude all implied warranties.

We are not liable for loss of profits, emotional distress, injury, or any consequential damages resulting from purchase or participation.

Our total liability is limited to the amount you paid for the Offering.
Nothing in this clause excludes your rights under ACL.
11. PRIVACY
We collect your name, email, and purchase details to deliver your Offering.
We will never sell your data.
Your information is handled per our Privacy Policy and Kajabi’s privacy practices.
12. TERMINATION OF ACCESS
We may suspend or cancel access immediately if:

You misuse or share content

You behave disruptively or disrespectfully in group spaces

Your payment fails and is not resolved
No refunds will be granted for terminations caused by your behaviour.
13. GOVERNING LAW
These Terms are governed by the laws of South Australia, Australia.
Any disputes will be handled in the courts of South Australia.
