Terms and Conditions for Your Heart + Soul Aligned Self

This Agreement is entered into by and between Michelle Louise Smith ("Coach") and the Client ("Client") purchasing this program, whereby the Coach agrees to provide said services for the Client. Coaching is an alliance between the Coach and the Client in a thought-provoking and creative process that inspires the Client to maximize personal and professional potential. It is designed to facilitate the creation/development of personal, professional, and/or business goals and to develop and carry out a strategy/plan for achieving those goals.

1. Client/Coach Relationship

• The Client is solely responsible for creating and implementing their own physical, mental, and emotional well-being, decisions, choices, actions, and results arising out of or resulting from the coaching relationship and their coaching calls and interactions with the Coach.

• The Client agrees that the Coach is not and will not be liable or responsible for any actions or inaction, or for any direct or indirect results of any services provided by the Coach.

• The Client understands that coaching is not therapy, does not substitute for therapy, and does not prevent, cure, or treat any mental disorder or medical disease.

• The Client acknowledges that coaching is a comprehensive process that may involve different areas of their life, including work, finances, health, relationships, education, and recreation.

• The Client agrees to communicate honestly, be open to feedback and assistance, and to create the time and energy to participate fully in the program.

• The Client understands that any transformation requires effort, commitment, and personal responsibility for follow-through.

2. Schedule and Fees

• The agreed investment for Your Heart + Soul Aligned Self is $5,500 for six months from the date of purchase.

• Payment plans are available and must be agreed upon prior to the start of the coaching program.

• Payment is required upfront or according to the agreed payment plan.

3. Refunds and Cancellations

• All sales are final. There are no refunds once payment has been made.

• Session times cannot be rescheduled by the Client. If the Coach cannot make a scheduled session, it will be rescheduled at the Coach's earliest availability.

• All group video calls will be recorded and uploaded to a private portal for replay access.

4. Confidentiality

• This coaching relationship, as well as all information (documented or verbal) that the Client shares with the Coach and the Coach shares with the Client as part of this relationship, is strictly confidential.

• However, please be aware that the Coach-Client relationship is not considered legally confidential (like medical or legal professions), and thus communications are not subject to the protection of any legally recognized privilege.

• The Coach agrees not to disclose any information pertaining to the Client without the Client's written consent.

• The Client acknowledges their ongoing obligation to raise any confidentiality questions or concerns with the Coach promptly.

• In the event of illegal activity, self-harm, or harm to others disclosed by the Client, the Coach reserves the right to notify the appropriate authorities.

5. Limited Liability

• The Coach makes no guarantees, representations, or warranties of any kind, express or implied, with respect to the coaching services provided.

• In no event shall the Coach be liable to the Client for any indirect, consequential, or special damages.

• The Client's exclusive remedy shall be limited to the amount paid by the Client to the Coach under this Agreement.

6. Client Responsibilities

• The Client is responsible for attending all scheduled sessions on time.

• The Client agrees to complete assigned exercises, reflections, and action steps between sessions.

• The Client acknowledges that results are dependent on their active participation, commitment, and willingness to apply the strategies discussed during sessions.

• The Client agrees to communicate openly about any challenges, blocks, or concerns that arise during the program.

7. Coach Responsibilities

• The Coach will provide a safe and supportive space for emotional healing, reflection, and growth.

• The Coach will provide tools, strategies, and resources tailored to the Client's unique needs and goals.

• The Coach will maintain professional boundaries and uphold confidentiality as outlined in this Agreement.

• The Coach will notify the Client in advance of any unavoidable scheduling changes.

8. Intellectual Property

• All materials, worksheets, meditations, frameworks, and resources provided by the Coach are the intellectual property of the Coach.

• The Client agrees not to share, reproduce, or distribute any program materials without written consent from the Coach.

• Materials are intended for personal use only and cannot be used for commercial purposes.

9. Termination of Agreement

• The Coach reserves the right to terminate the coaching relationship if the Client fails to honor their financial commitment, engages in inappropriate behavior, or does not actively participate in the program.

• No refunds will be issued upon termination.

10. Dispute Resolution

• In the event of a dispute, both parties agree to seek resolution through open communication and mediation before pursuing legal action.

• Any legal proceedings will be governed by the laws of South Australia, Australia.

11. Acknowledgment

By purchasing Your Heart + Soul Aligned Self, the Client acknowledges that they have read, understood, and agree to these Terms and Conditions. The Client also acknowledges that they are responsible for their results and actions taken throughout this program.
